A call for greater HOA oversight in Florida

Miami-Dade County and the surrounding areas are a beautiful place to call home, and you have a variety of options when it comes to owning property in the state, including condominiums. These communities often have homeowners’ associations, which are supposed to provide benefits to you as a member of the neighborhood. Although there are Florida statutes dealing with the rights and responsibilities of HOAs in the state, some people believe these are not being enforced properly. According to the Miami Herald, the Florida Department of Business Regulation and Professional provides condominium oversight. However, there is not currently a law enforcement agency or special unit designated to enforce the regulations that should protect you as a condo association member. Those who have investigated claims of corruption in more than one HOA state that this lack of official supervision has resulted in ongoing illegal activity that has led to financial damages for residents in many communities.

Crimes such as fraud or forged signatures have been uncovered that should lead to harsh prosecution, although in many cases they have been unaddressed. Not only would legal action provide reparation for those who have been victimized, it may also provide protection from wrongdoing in your own association and others in the state. Although those who have perpetrated these activities have been placed in the spotlight, there is still a call for greater implementation of justice for members of HOAs.
