The Immigration Court Practice Manual

There are many resources that can provide guidance for you as an immigrant in Miami preparing to interact with the federal court system as part of the immigration process. We at Cuevas and Garcia, P.A., are aware of the complexities of the rules and regulations that are part of appearing before the U.S. Immigration Courts.

The U.S. Department of Justice provides a practice manual within which you may find instructions on your appearance before the Immigration Court. It includes court procedures, as well as the requirements you must fulfill when you appear before the judge to address your specific case. If you have consulted this manual in the past, it is a good idea to review it again for updates because it is subject to changes as directed by the Office of the Chief Immigration Judge.

While the practice manual states that you do have the right to represent yourself, you may not be represented by a notario publico, a visa consultant or an immigration specialist who is not an attorney. In most cases, only attorneys who are registered with the Executive Office for Immigration Review and who are in good standing with the Florida Bar Association may provide representation.

From the practice manual, you may learn details about how to conduct yourself before an immigration judge, how to file a motion, and information about the appeals process. Which forms are necessary for specific procedures, how to find them and how to submit them are explained, as well. This document also outlines deportation proceedings and what to expect.
