Man granted adjustment of status through defensive asylum process

Many people arrive in Florida from other countries of origin without having all their paperwork in order. This can create numerous legal problems as they begin new lifestyles in the United States. Some people, such as a 64-year-old man who came to the U.S. in 1992, successfully obtain adjustment of status through the defensive asylum process.  

The person in this particular case said he came to the United States from Mexico because there was no work to be found in his country at the time. Unfortunately, the man was taken into custody by police last May for alleged public drunkenness. At some point, he was transferred to an immigration detention center and placed at risk for immediate removal.  

The U.S. government granted the man protection under defensive asylum, which is a status applied to political refugees who enter the United States without proper documentation. This type of asylum is processed by the U.S. Department of Justice as opposed to affirmative asylum, which is granted to immigrants who cross U.S. borders with all their paperwork in order. Affirmative asylums are processed by U.S. Citizenship and Immigration Services.  

Seeking an adjustment of status in Florida or any other state can be a confusing process that is quite stressful. Those navigating the process while being held in immigration detention centers are often fearful that they will be deported, perhaps even permanently separated from their loved ones. Many immigrants are able to obtain successful outcomes by acting alongside experienced legal representation.
