Florida real estate disputes erupted when homeowner filed lawsuit

Many Florida communities include homeowners associations. They are typically organized to govern maintenance, preservation and enhancement of subdivision properties. A homeowner in University Park has taken legal action regarding real estate disputes involving a proposed purchase of University Park Country Club.

The homeowner has filed a lawsuit, which is scheduled to be heard in a judicial circuit court. The lawsuit requests that the court stop the pending purchase of the country club. Among other allegations, it is alleged that homeowners acted under duress when they signed a petition to create a special recreation district, which made it possible to purchase the club and its 27-hole golf course.

The plaintiff has also asserted that the district failed to conduct a sufficient independent investigation or audit before agreeing to purchase the property. Finally, the lawsuit alleges that only the sellers' best interests are being served without regard for the rights of the homeowners, of which there are more than 1,500 who are registered voters in the community. The land in question is comprised of more than 1,200 acres, as well as more than 50 ponds and lakes.

While the vote to form the recreation district which had authority to make the purchase was unanimous, the lawsuit regarding these real estate disputes claims that homeowners were pressured, misled and harassed into signing the petition. The judge overseeing the case will soon determine whether there is merit to the plaintiff's assertions.
